1. Terms

1.1 These terms apply from the time you make a booking to attend one of our trips. If anything in this Document differs from what you have been told by our people, this document will take precedence.

1.2 By placing your booking for our trips either online or by email or by telephone you accept and agree to abide by these terms and conditions.

1.3 By providing your Personal Information to us, you agree to our Privacy Policy.

1.4 We have not waived our rights if we do not enforce any right contained in these terms during a particular time frame.

1.5 (a) We may add to, change or remove any of the terms and conditions or other clauses within this Document.

(b) The most up to date version of these terms will always apply. Copies of the current version of these terms are available on our Website.

(c) 21 days notice will be provided of any change to these terms by:

(i) putting a notification on our Website;

(ii) publishing the new document on our Website.


Travel

2. Travel arrangements

2.1 trips include the specified accommodation, classes, activities and specified meals.

2.2 trips do not include insurance, taxes, airport transfer (unless specified otherwise), air fares or other travel costs outside of the specified. It is your responsibility to make arrangements and pay for travel to Our trip locations.

2.2 It is your responsibility to ensure that you have a valid passport, visa and re-entry permits which meet the requirements of the immigration and other government authorities in the trip locations (Travel Documents). By making a trip booking with us you warrant that you have all Travel Documents required to attend the trip. Any fines, penalties, payments or expenditures incurred as a result of Travel Documents not meeting the requirements of those authorities will be your sole responsibility.

2.3 It is compulsory that you take out appropriate travel insurance for the duration of the trip and we will request policy details prior to departure. This travel insurance must cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. It is strongly recommended that such cover also covers cancellation, curtailment, personal liability, loss of luggage and personal effects. If Customers do not have travel insurance, they may be prevented from joining the Trip.

2.4 You must familiarise yourself with any health requirements and recommended precautions relevant to your travel to our trips and ensure that you carry all necessary vaccination documentation. You should consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel to Our trip destination.

3. Your health and age

3.1 You must be at least 18 to participate in Our trips.

3.2 Upon each booking of a trip, and each time you attend one of Our trips and participate in trip related activities, you warrant that:

(a) you are in good medical and physical condition; and

(b) there is no reason, medical or otherwise, why you should not undertake activities

3.3 We reserve the right to refuse you from participation in an upcoming trip (that has not departed), from parts of a trip (that has departed), or related trip activities, without refund, if:

(a) we perceive a reasonable risk of injury to you or any other person due to your participation; or

(b) we perceive that you have an infection, covid-19, contagious illness, physical ailment or open cut or sore; or

(c) we perceive your behavior to be aggressive, disruptive, antisocial, discriminatory, predatory, illegal or in any way inappropriate to the well-being of other travellers, or staff, and the overall trip experience prior, during or after the trip; or

(d) we perceive your behavior to be threatening, or violent; or

(e) you do not adhere to community guidelines below

3.4 By participating in any trip and any related trip activity you agree to the following:

(a) You’ll comply with directions and policies.

(b) You acknowledge that any type of activity / exercise involves risk of injury which may result in death or serious disability.

(c) Despite such risk you agree that you participate entirely at your own risk of injury or bodily harm to yourself and others.

(d) You release Us and all of Our People and any other persons involved in my participation in any activity with Us from any action, claim, suit or demand for compensation whether for damage to property or personal injury arising from your participation.

(e) You understand that these terms are contractual and may be relied upon in any proceedings by or involving you and your heirs, executors and assigns.

(f) To the fullest extent permitted by law, we make no warranties about the goods or services we supply. Where you have the benefit of guarantees that cannot by law be excluded or varied, our liability for breach of any such guarantee is limited (at our option) to:

(i) repair or replacement of goods;

(ii) re-supply of services;

(iii) payment of the cost of same.

3.5 (a) Our People are not medically trained;

(b) Our People are not qualified to assess if you are in good physical condition;

(c) Our People are not qualified to assess if you are physically capable of any of the active or passive exercises without risking your health, safety or comfort.

(d) We strongly suggest you seek expert advice before participating in our trips.


Liability

4. Liability

To the extent permitted by law, neither We nor any of Our related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.

5. Fees

5.1 Our current fees for Our trips are available on our website. trip fees do not include airfares or other travel costs, insurance or taxes.

5.2 To secure your spot on all trips, you must pay a non-refundable deposit. This is due to the prepaid nature that we must adhere to at our venues.

5.3 Remaining / final balance (trip cost minus deposit) is due 45 days to 90 days prior to the start date of the trip, depending on trip specifics.

5.4 If you book 45 days or less prior to the start of the trip, you must pay full amount at time of the booking.

5.5 Payment of final balance payment of fees for your trip is to be paid via bank transfer.

5.6 Fees for our trips are subject to availability and we reserve the right to withdraw or change our fees for a trip, and to change trip itineraries, at any time prior to trip occuring.

5.7 Transfer of bookings for Our trips are not permitted.

5.8 There will be no refunds of trip fees in any circumstances.

5.9 payments via credit card will incur a surcharge of 2.9% (this is the merchant fee we are charged for the transaction)

6. Cancellation Policy

6.1 Aweventurer does not offer refunds. This is due to the prepaid nature that we must adhere to at our venues.

(a) Your deposit is non-refundable in all circumstances

(b) If you cancel 45 days or less prior to the trip, you will forfeit all payments made towards the trip.

(C) IF THE TRIP HAS NOT BEEN PAID IN FULL BY THE DUE DATE AS SPECIFIED ON THE INVOICE, WE RESERVE THE RIGHT TO CANCEL YOUR PLACE AND RETAIN THE DEPOSIT.

(D) Trips paid ‘in-full’ will be given scheduling priority to trips paid with ‘deposit only’.

6.2 Exceptions to our policy cannot be made for any reason, this is why it is imperative to get travel insurance as soon as you have paid the deposit. Please make sure that natural disasters and personal injuries are covered. We do not offer credit for arriving late or leaving early.

6.3 All cancellations must be made in writing via email to operations@aweventurer.com; The deposit is non-refundable and is subject to the refund policy – listed above.

6.4 Aweventurer may cancel the trip if a minimum quota of attendees has not been reached within 3 weeks prior to trip date. minimum quota of attendees dependent on trip.

6.5 Aweventurer shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of God’, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors that cause a delay or cancellation of trip or its services.

6.6 Aweventurer is not responsible for any expenses incurred in preparation for any cancelled trip, such as airline tickets, loss of work, and/or other costs associated with preparation for your trip. It is imperative to get travel insurance as soon as you have paid the deposit.

6.7 any refunds for deposits made via credit card will have a 2.9% merchant fee deducted


Governing
law and
definitions

7. Governing law

These terms are governed by the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

8. Definitions 

activities means all, classes, workshops and sessions (whether group or individual) with Our People.

Facilities means the premises in which the trip is located as well as all its contents.

Our People means any staff or contractors of Aweventurer.

Personal Information means any information capable of identifying an individual including name, address, phone number and email address.

trips means the activities and events organised by aweventurer at various locations from time to time which may include Yoga, breath work, hiking, meditation and other wellness classes and related activities, as well as accommodation and meals. Individual trip activities, itineraries, fees and payment arrangements, and availability will be in accordance with individual trip descriptions posted on our Website and may be subject to change.

In order to ensure we provide the best experience that brings travellers back home transformed, all travelers agree to the following traveler guidelines upon booking their trip:

KNOW THE DETAILS

o   Please read the full itinerary, accommodation types, and specifics on the trips (remote vs. city location; shared vs. private room; trip theme and focus; etc.) and are OK prior to booking

 BE AGILE

o   Travel plans always have ‘bumps’ from time to time, and more so in a post COVID world;  travelers understand their will be last-minute changes to itinerary may occur, flights are delayed, and weather isn’t always great – but our team will communicate changes as they happen and we won’t let a little rain ruin our day. The itinerary is a guideline only, and the final call on itinerary changes rests with the Aweventurer team.

UNDERSTAND YOUR COMFORT

o   Trips usually involve a lot of walking and moving from location to location.  This includes sleeping in beds that aren’t the ones you have at home, as well as weather and climate that is vastly different than what you are used to -  don’t be discouraged, but do understand whether you are comfortable with the type of trip you are signing up for prior to booking

 RESPECT YOUR GUIDE

o   Your local guide has been provided to ensure you have a wonderful and informative trip according to the itinerary.  Any free time or extra curricular activities are up to travelers to organize; unless it’s an emergency, let the guide have some down time in between showing you the best the destination has to offer

 BRING YOUR BEST SELF

o   Be a kind and considerate person that treats others with respect and dignity; transformative travel is about opening yourself up to learning something new, creating new connections, and embracing change; when in doubt, be someone that other people want to be around (or at the very least, don’t want to not be around)

BE CURIOUS

o   Bring an open and inclusive mindset to the people you meet and places you visit;  your trip should be an opportunity to step outside your comfort zone, try new and weird things; whilst differing views is encouraged; ensure to do so with consideration and empathy;  always treat others with respect and and dignity; you will be travelling with people from all different backgrounds, countries, and cultures – use it as a chance to learn and grow

RESPECT OTHERS PRIVACY

o   In a social media dominant world, be respectful of others digital privacy by not taking photos, sharing personal information, or anything deemed sensitive without first receiving their consent;  remember that your trip is meant to relaxing and a source of enjoyment – not stress and anxiety

ACT SAFELY

o   Staying safe and using common sense should be top of mind at all times;  although you will be travelling to known locations with an experienced guide, it is still important to remember to mind your surroundings at all times

DON’T BE INNAPPROPRIATE

o   No hate, bullying, sexist, racist, trolling, passive aggressive, gossiping, threatening or perceivably inappropriate speech or actions will be tolerated (either on trip or via any communication mediums); if you think it’s something that will offend someone, you wouldn’t want directed to you, or  would get you fired from a workplace or team – then keep it to yourself.  Anyone found to be promoting negative speech will face removal from Aweventurer communication mediums and possible removal from the trip.

o   Be mindful of your effect on the group dynamic. Gossip about other travellers, Host or staff will not be tolerated.

RESPECT YOUR HOST AND OUR TEAM

o   Everyone deserves a safe space. Gossiping, threatening or bullying our staff or Host will not be tolerated.

 FOCUS ON TRAVEL

o   We encourage organic conversation on work and business amongst travelers, but ask all travelers refrain from any advertising another business, sharing spam, or active self promotion.  If you think it will be additive to the trip or experience, please let us know first.

ENJOY YOURSELF

o   Each trip is meant to leave travelers transformed – how best to do this than to ensure you have the best time you can, by making positive and last memories for yourself and leaving those around you better than you found them; 

 Failure to adhere to the above requirements may result in removal from Aweventurer platforms, as well as current and future trips.  Aweventurer reserves the right to take appropriate steps to prevent and stop any behaviours that are not inline with the above guidelines.  By booking a trip, you are in agreement with the guidelines listed above (also referred to within our T&C’s).  We ask all travelers to report any behavior that violates our guidelines to operations@aweventurer.com
